Tamasha Service Data Processing Terms & Conditions

Gundua Solutions Ltd., (hereafter the Company or WE) registered owners of the Tamasha Tenant mobile app, Web Portal and Website (together, “Service” or “Services”) are committed to protecting and respecting your privacy.

1.0 Scope of the Data Processing Terms and Conditions

1.1 These Data Processing Terms and Conditions together with our Terms of Use and Loyalty Program Terms and Conditions as set out at our site at www.tamasha.or.ke and any additional terms of use applies to your use of:

1.4 You can withdraw your consent to our collection, processing or use of your personal information at any time by making a request on info@gundua.net or via a contact link on the App or web portal. Once fulfilled, the Company will proceed to close your account.

Information collected by us shall be processed and used for the purpose of enabling you to make transactions or to provide any of our Services to you. We are unable to provide these functionalities unless we collect and process data in accordance with our terms and conditions.

Save in compliance with an order of the Court, Arbitral Panel, Tribunal, Regulatory Directive or Order or any other legal or regulatory obligation, we do not disclose information about identifiable individuals to other parties, but we may provide them with anonymous aggregate information about our users (for example, we may inform them that we have 500 users actively using our services)

6.1 The data that we collect from you may be transferred to, and stored at, a destination outside your country of origin or residence (as applicable). It may also be processed by staff operating outside your country of origin or residence (as applicable), who work for us or for one of our suppliers. These staff members may be engaged in the fulfilment of your requests on the Service Sites. Data stored outside Kenya may be subject to the laws of the country in which it is stored. By submitting your personal data, you agree to the collection, transfer, storing or processing of your personal data in the manner set out above. We will take all steps reasonably necessary to ensure that your data is treated, stored and processed securely and in accordance with these Terms and Conditions.

6.2 Where we have given you (or where you have chosen) a password that enables you to access certain parts of Our Service Sites, you are responsible for keeping this password confidential. We ask you not to share a password with anyone. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to Our Service Sites; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security safeguards to try to prevent unauthorized access.

7.1 We implement and maintain appropriate safeguards to protect personal data, taking into account in particular the risks to you, presented by unauthorized or unlawful processing or accidental loss, destruction of, or damage to your personal data.

7.2 Safeguarding may include the use of encryption and pseudonymisation where appropriate. It may also include protecting the confidentiality (i.e. that only those who need to know and are authorized to use personal data have access to it), integrity and availability of the personal data. We regularly evaluate and test the effectiveness of those safeguards to ensure the security of our processing of personal data.

8.1 We will use your data for the purposes of determining whether or not to provide a service to you. We may also use your data to compile statistics relating to our user base and may disclose such information to any third party for such purposes, provided that such information will always be anonymous.

Changes to Terms and Conditions

Any changes we may make to these Terms and Conditions in the future will be posted on this page and, where appropriate, notified to you when you next start the App or log onto one of the Service Sites. The new terms may be displayed on-screen and you may be required to read and accept them to continue your use of the App or the Services. In any event, by continuing to use the App or any Services after the posting of any changes, you confirm your continuing acceptance of these Terms and Conditions together with such changes, and your consent to the terms set out therein.

The data collected is voluntary and not mandatory or pursuant to any law in Kenya.
